At a community complex a group of people are employed as security guards and are being paid between R80.00 & R100.00.This is for day & night shift including Sundays and Holidays.

No one is registered and the one or two who are registered are being payd the same.

  10. Hi,please I would like to know is it illegal to work for a company for more than a year and they still consinder you as an independent contractor. But why is it that companies nowadays allowed to employ people on independent contracts.

    • Madelein van der Watt

      Hi Oscar

It is not illegal provided the employment relationship agrees with the definition of an independent contractor. The contractor is only independent if he provides a service to the employee and invoices the employer for services rendered. The relationship is more like a customer and service provider. It becomes and employee/employer relationship where the contractor receives 80% or more of his regular remuneration from a single customer and the customer controls the working hours and resources used in providing such service.
Fixed-term contracts are not illegal but be aware of major changes to our employment legislation that is currently being reviewed. These changes will have a major impact on fixed-term contracts and the relationship between the employer and contractor.

    Yours faithfully
    Victor Cekiso

  17. Madelein van der Watt

    Hi Victor

The current minimum wages still applicable until 31 August 2013 are available at http://www.psira.co.za/joomla/pdfs/MinumumWagesEffective01092012.pdf

Your basic wage can be calculated per hour or paid as a monthly salary. As far as my knowledge goes, bonuses are discretionary and are not compulsory in your industry.

Hi.I am Grade B in Kzn.if I give 24 hour.notice is employer entitled to take deduction for uniforms?I have worked 7 mnths 19 days for same company.what can employer deduct from final salary?I have better job and salary but they need me to start asap.thnx 0794432070

    • Madelein van der Watt

      Hi Michael

According to the Basic Conditions of Employment, if you are employed for more than 6 months but less than two years, you must give an employer at least two weeks notice. Your employer will not have to pay you two weeks notice pay if you give only 24 hour notice. Your employer is also entitled to recover any money you might be owing, whether it is for loans or uniforms that you had to repay, from your final payslip.

security is there to prevent it please do. help me out thank you. Regards shaun

    • Madelein van der Watt

      Hi Shaun

The minimum wages that became effective 01 September 2013 are available to download from http://www.psira.co.za/psira/dmdocuments/circular/PRICING%20STRUCTURE%202013%20to%202014.xls

You may lookup the relevant rate for your grade and area on this document published by PSIRA on their website.

I have noticed an individual posting comments about a possible strike – I cannot comment on that as I have no affiliation with any union or PSIRA for that matter. This blog, provided by Sage Pastel Payroll & HR, is used as a forum to share employment and tax related topics with the public.

      Regards

      Madelein
